Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Massage Controller mobile application (the "App"), operated by Mathieu Meesters, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Massage Controller is a mobile application available on iOS and Android that allows users to control vibration patterns on compatible wireless game controllers via Bluetooth, as well as through the device's built-in vibration motor. The App provides various vibration patterns, touch mode, remote control mode, ambient audio, and background vibration.

4. Free Access and Legacy Users

Users who installed the app before the introduction of the premium subscription may retain free access to the app's features, subject to the following technical limitations:

• This access is stored locally on the device and may be lost if the app is uninstalled (voluntarily or automatically by the platform to free up storage), the app data is cleared, the device is reset, or in any other case where the local device storage associated with the app is erased or reset
• This access is not transferable to a new device
• Free legacy access cannot be guaranteed in all cases due to technical limitations

New users have access to a limited daily use of the gamepad vibration feature before being invited to subscribe to a premium plan.

5. Premium Features

Massage Controller offers the following premium plans:

• Weekly subscription — auto-renewable, cancel anytime
• Lifetime access — one-time purchase, no subscription, no recurring payment

Both premium plans unlock:

• Unlimited gamepad vibration (no daily limit)
• Access to all vibration patterns
• Touch mode and remote control mode
• Background vibration mode
• No advertisements

6. Subscriptions and Auto-Renewal

The weekly subscription is an auto-renewable subscription. Payment will be charged to your Apple ID or Google Play account at confirmation of purchase. The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.

You can manage and cancel your subscription at any time through your device's account settings:

• iOS: Settings > Apple ID > Subscriptions
• Android: Google Play > Account > Subscriptions

No refund will be provided for the unused portion of a subscription period upon cancellation. Access to premium features will continue until the end of the current billing period.

7. Purchases and Refunds

All in-app purchases are processed by Apple App Store or Google Play Store depending on your platform. Payments are also managed through RevenueCat, a third-party subscription management service. Mathieu Meesters does not directly handle any payment or financial transaction. Refund requests are subject to the policies of the respective platform:

8. Restore Purchases

If you have previously purchased a premium plan, you can restore your purchase at any time through the "Restore Purchases" option available in the paywall or in the Help & Settings screen, provided you are logged in with the same Apple ID or Google account used for the original purchase.

9. Acceptable Use

9.1 Permitted Uses

You may use the App for personal, non-commercial purposes in accordance with these Terms and applicable laws.

9.2 Prohibited Uses

You agree NOT to:

• Use the App for any unlawful purpose or in violation of any applicable law
• Attempt to reverse engineer, decompile, or disassemble the App
• Distribute, sell, rent, lease, or sublicense the App
• Use the App in any manner that could damage or impair gaming controllers or mobile devices

10. Health and Safety

10.1 Controller Usage

• Gaming controllers must be used in accordance with their respective manufacturer's guidelines
• Users are responsible for ensuring controllers are compatible and in good working condition
• Do not use damaged gaming controllers with the App

10.2 Physical Safety

• Use the App responsibly and at your own risk
• Start with lower intensity settings
• Discontinue use immediately if you experience any discomfort or adverse reactions

11. Third-Party Trademarks

Massage Controller is compatible with certain wireless game controllers. The following brand names and trademarks are the property of their respective owners:

• PlayStation, PS4, PS5, DualShock, DualSense are trademarks of Sony Interactive Entertainment LLC.
• Xbox is a trademark of Microsoft Corporation.
• Nintendo is a trademark of Nintendo Co., Ltd.

Mathieu Meesters is not affiliated with, endorsed by, or sponsored by Sony, Microsoft, Nintendo, or any other controller manufacturer. The use of these names is solely for the purpose of identifying compatible hardware.

12. Third-Party Services

The App integrates with third-party services including:

• Google AdMob (advertising)
• Firebase Analytics (usage analytics)
• Firebase Crashlytics (crash reporting)
• Firebase Remote Config (app configuration)
• RevenueCat (subscription management)
• Platform-specific services (Google Play Services, Apple services)

Your use of these third-party services is subject to their respective terms and privacy policies.

13. Intellectual Property

13.1 Our Rights

The App, including all content, features, and functionality, is the exclusive property of Mathieu Meesters and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App without prior written permission.

13.2 Your Rights

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the App for personal purposes.

14. Advertising

The App may display advertisements through Google AdMob for users who have not subscribed to a premium plan. You acknowledge that:

• Advertisements are provided by third parties
• We do not endorse or guarantee any advertised products or services
• Your interaction with advertisements is subject to the advertiser's terms and policies

15. Privacy and Data

The App operates without requiring user authentication or personal accounts. Our data practices are governed by our Privacy Policy, which is incorporated into these Terms by reference.

16. Disclaimers and Limitations of Liability

16.1 Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

16.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MATHIEU MEESTERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE APP.

16.3 Device Damage

We are not responsible for any damage to gaming controllers, mobile devices, or other hardware that may result from use of the App. Users assume all risks associated with hardware compatibility and usage.

17. Changes to the Service

Mathieu Meesters reserves the right to modify, suspend, or discontinue the App or any of its features at any time, with or without notice. Mathieu Meesters shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

18. Changes to These Terms

We may update these Terms of Use from time to time. You are advised to review this page periodically for any changes. Continued use of the App after any changes constitutes your acceptance of the new Terms.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions. Any disputes arising from these Terms or the use of the App shall be subject to the exclusive jurisdiction of the courts of Belgium.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will remain in full force and effect.
